TERMS AND CONDITIONS
These conditions of sale are concluded, on the one hand, by Pili Garcia via its website, hereinafter referred to as "the seller" and, on the other hand, by any natural or legal person wishing to make a purchase via the site. Internet of the seller, hereinafter referred to as "the buyer". Accepting the terms and conditions of sale means that you accept these terms and conditions of sale.
1. Object
These conditions of sale aim to define the contractual relationship between the seller and the buyer as well as the conditions applicable to any purchase made through the site www.piligarcia.com , whether the buyer is a professional or a consumer. The acquisition of a product through this site implies unreserved acceptance by the buyer of these conditions of sale.
These conditions of sale shall prevail over any other general or specific conditions not expressly approved by the seller.
The seller reserves the right to modify its conditions of sale at any time. From then on "Pili Garcia » invites the customer to check the general conditions of sale for each order. The applicable conditions will be those in force on the date of the order by the buyer. In the event that the customer does not agree with these, he must immediately stop using the services of "Pili Garcia ". The sale is reserved for adult or minor customers with parental authorization.
2. Products
The products offered for sale by Pili Garcia are those which appear on the seller's website. Each of them is accompanied by a description established by it. The products offered for sale are described as precisely as possible.
However, if errors or omissions may have occurred in this description, the responsibility of the seller cannot be engaged. The photographs on the site are as accurate as possible.
These products are offered within the limits of available stocks. If, despite its efforts, all or part of the items are unavailable, the seller informs the buyer by email as soon as possible and offers him the possibility of choosing between waiting or canceling the order of the unavailable items free of charge.
3. Price
The prices of the products displayed on the site are indicated in euros. They take into account any reductions as well as VAT, applicable on the day of the order. The prices indicated are guaranteed within the limits of available stocks except for significant changes in charges and in particular VAT, and except for typographical errors or omissions.
The seller reserves the right to modify its prices at any time. However, the prices applicable to the order are those in force at the time of confirmation thereof. The prices indicated take into account the packaging provided by the seller but do not take into account the shipping costs which will be invoiced in addition and will be specified to the customer during the final validation of his order.
The articles remain the property of Pili Garcia until full payment of the price of the order.
4. Order
The customer must follow the following procedure:
Browse the site and choose the article(s) they like. He will then add them to his basket, by clicking successively on the “Add to basket” button. At any time he will have the possibility of:
Click on the basket icon to get a summary of the items in your basket;
Click on the basket icon (at the top of the site) followed by the “validation of the order” button once the selection of items is complete in order to place an order.
During his first order, the customer will have to fill in his customer file and give his personal information allowing the execution of the order. He will also have the choice to create a personal account on the site in order to facilitate his next purchases.
If the customer already has a personal account, he can then connect to it using his e-mail address and password.
Once the user has been identified and the selection of items has been made, he must validate the delivery and/or billing address
The customer will then choose his method of delivery or withdrawal of the order from the various choices offered on the site. Namely: home delivery, delivery to a relay point or pick-up in store.
The customer will choose the type of payment he prefers, Visa, MasterCard, postal transfer, …) and will fill in the information required by the secure payment platform.
Finally, the client will pass definitively and irrevocably his order by clicking on the “order” button. Therefore, he affirms to have read, to have read and to have accepted the general conditions of sale as well as the confidentiality policy. He also certifies to be over 18 years old or otherwise to have parental authorization to proceed with the order. The minor will also inform the parental authority of the collection of his personal data. The seller will acknowledge receipt of the order upon validation by e-mail.
In any case, Pili Garcia reserves the right to refuse any order or any delivery in the event of an existing dispute with the customer, total or partial non-payment of a previous order by the customer, refusal of authorization to payment by bank card from banking organisations, non-payment or partial payment, use of a bank card or other means of payment not issued by a financial institution. The responsibility of Pili Garcia can then in no case be engaged in this respect. Pili Garcia also reserves the right to cancel any order without reason mentioned above by refunding the amount paid by the customer during his last order.
5. Deliveries
Deliveries are made to the address indicated on the order form.
Delivery times vary depending on the delivery method chosen. The seller tries to ensure delivery as soon as possible. However, the seller cannot be held responsible in the event of late delivery.
Delivery times are indicated for information purposes on the seller's website and those of delivery partners and are not guaranteed. If these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed.
The product is transported at the risk of the seller until delivery to the delivery address specified by the buyer. From this moment, the buyer alone assumes the risks.
In the case of international delivery (outside Belgium), the customer will be subject to the payment of import taxes and additional costs. The delivery prices vary from one country to another and are perfectly indicated when the customer gives his address on the site when placing an order.
The customer must comply with the applicable laws, taxes, customs and rules provided for in the country of destination. The seller will in no case be held for responsible if he violates these laws.
Please note that an order may be refused and refunded if its weight is less than the carrier's requirement.
6.Personal data
Any customer who has placed at least one order is registered automatically and free of charge in the Pili Garcia customer file. The seller ensures that the data will remain confidential and will never be transmitted unless agreed with the customer.
7. Availability
In the event that an item is unavailable after placing the order, the seller undertakes to promptly inform the customer by e-mail upon receipt of the information. The order will be automatically canceled and the customer immediately refunded if his account has been debited.
Reimbursement will be made directly to the customer's bank account at the latest within thirty days of payment of the amount paid by the customer.
8. Right of withdrawal
In accordance with the law, the consumer has the right to notify the seller that he renounces his purchase, without penalty and without giving any reason, the period expires after a period of 14 days from the day on which the consumer or a third party other that the carrier and designated by the consumer takes physical possession of the goods. Depending on the country where you reside, if the customer is a consumer, you have the right to cancel your order under the European Consumer Protection Directive 2011/83/EU. The amount may be revised downwards according to any additional costs incurred for transport.
We strongly recommend that the customer check the garments thoroughly at the time of delivery. Products must be returned unworn, unwashed, undamaged, unworn and with their original labels. In the event of non-compliance with these instructions, the returned product will be considered non-compliant under our return policy and the item will not be refunded. Items benefiting from promotions on our site may be taken back.
The items will be returned at the customer's expense by a secure delivery method.
It will be up to the customer to keep any proof of return, which assumes that the items are returned by registered mail or by any other means giving a certain date to this shipment.
In the event of an error in the communication of the delivery data, Pili Garcia will not be held responsible. In case of refusal by the customer of the package, the return postage will be applicable.
In case of withdrawal, the refund will take place within 14 days after the information of the return by the consumer.
The return costs are the responsibility of the customer but the reimbursement includes the price of the goods and the delivery costs initially paid by the consumer.
9. Warranty
The warranty only covers manufacturing defects existing at the time of delivery of the products. Defects or damage due to heavy use, normal product wear, addicting or any other reason are not covered by the warranty.
All goods sold on the Pili Garcia site benefit from the legal guarantee against any lack of conformity.
10. Modification of the general conditions of sale
We reserve the right, at our sole discretion, to update, change or replace any part of these Terms and Conditions of Sale and Use by posting updates and changes to our site. It is your responsibility to visit our site regularly to check whether any changes have been made. Your continued use of or access to our site following the posting of any changes to these Terms and Conditions of Sale and Use constitutes acceptance of those changes.
11. Force majeure
Cases of force majeure (strikes, fires, epidemics, danger of war, civil war, lack of energy resources, act of the prince, bankruptcy of suppliers, etc.) are to be considered as hypotheses of force majeure when they have the effect to delay deliveries.
The seller will inform the customer as soon as possible by email of the occurrence of one of these circumstances and the latter reserves the right to extend the delivery time. Similarly, if these facts may compromise the execution of the order according to the terms provided, the seller also reserves the right to terminate the contract.
12. Dispute
These general conditions are subject to Belgian law. In the event of a dispute, Belgian law is applicable and only the courts of the judicial district of Liège are competent.
